You should always fight a charge of careless driving. Fighting the charge cannot make it worse, so the worst-case scenario is that you end up with the same consequences you would have received even if you had just paid the ticket. Remember that paying a ticket is the same thing as pleading guilty! Whether you hire a representative or attempt to fight the ticket yourself, it is worth your while to fight your ticket.

Because of the careless driving charge encompasses so many possible actions, our paralegals at Road Warriors are often able to, based on the evidence provided in the disclosure from the prosecution, at least have the charge reduced to a lesser charge in the HTA, something more specific than careless driving and with far less dire consequences. Minor charges will still appear on your record and affect your insurance, but nothing to the extent of a major charge like careless driving. Very few Part 1 careless driving charges succeed if you are properly defended by a professional who has had time to review the officer’s notes and other evidence.

Do your research, take detailed notes of the incident in which you received the ticket, and contact a paralegal or lawyer to find out what options you have. Make sure to get started as soon as you can after receiving a careless driving ticket! The sooner you take action, the more fresh your own memory will be, and the more time you’ll have to make sure you take every action you can to defend yourself.
