DRIVING WHILE UNDER SUSPENSION

WHAT HAPPENS IF I DRIVE WHILE MY LICENSE IS SUSPENDED?

Driving while your license is suspended is a very serious offence. The charge of driving while under suspension is one of the worst charges you can receive under the Highway Traffic Act (HTA) and is one of the hardest to fight. It can carry a fine of up to $5,000, the possibility of jail-time, an extended period of further license suspension, and drastically increased insurance rates.

Moreover, the more you drive while your license is suspended, the worse things can get. Each additional conviction of driving while under suspension will increase the likelihood of jail-time in addition to raising the fine higher and higher. More importantly, each additional conviction also leads to a mandatory additional six months of suspension on your driver’s license, making it that much harder to get back to driving legally.

WHAT DO I DO IF I HAVE A CHARGE OF DRIVING WHILE SUSPENDED?

If you’ve received a charge of driving under suspension, you should immediately seek help from a legal representative, either a lawyer or a paralegal skilled in traffic law. Because this charge is one of the most serious in the HTA, it can carry huge fines, the possibility of jail-time, and an even-longer period of license suspension. The more often you drive under suspension, the worse the fines will get and the longer your suspension will be, so it can quickly snowball into a situation out of your control.

A professional legal representative will be able to help you discover what your options are and put together a defence. It’s very important to get representation because you will need every possible defence to either fight this charge or find a way of mitigating it enough that it won’t irrevocably affect your life afterward. The courts and insurance industry are very harsh toward this charge, so do your research as to your situation, write down everything that happened and seek legal help right away.
